Terms
I. Company
Under the protected brand names SUBEX and SUBEX THE ART OF DIVING, water sports activities are carried out through a company registered in Egypt under the name Sub-Egypt L.L.C. The company is located in Cairo/Egypt. The head office is in Hurghada, Al Dahar. SUBEX operates diving centres at the locations Hurghada, Sahl Hasheesh and Sharm El Sheikh.
II. Scope of application
The GTC apply to all SUBEX customers, as well as tour operators and/or retailers. For tour operators and/or retailers, the sales conditions for tour operators and/or retailers as specified in the contract shall apply additionally.
III. Prices
SUBEX currency is Swiss franc (CHF). The prices are therefore based on CHF. They are also shown in the currencies Euro (EUR) and US Dollar (USD). The current prices are published on the homepage www.subex.org under PRICES or GOOD TO KNOW - Downloads. The prices published there always apply, unless other agreements have been made in writing.
IV. Reservation
Reservations can be made by e-mail, via the contact form on our website, WhatsApp or by telephone. The reservation is considered confirmed as soon as a written reservation confirmation is received. Payment for a reservation is made on site.
V. Booking
Bookings are made by e-mail or via our website. A booking becomes binding as soon as a written booking confirmation including invoice is received. The invoice is issued in CHF or EUR, which must be paid to our account in the corresponding currency.
VI. Payment
We offer the following payment options:
1. Advance payment after invoice
- Payment at the latest 2 days before arrival.
2. Payment on site in cash or by credit card
- Cash payments can be made in Swiss francs (CHF), Euro (EUR), US dollars (USD) and Egyptian pounds (EGP). When paying in EGP, the current exchange rate converted from CHF to EGP. The current exchange rate is clearly displayed in the diving centers. It is based on the average value of purchases and sales according to the official bank rate CHF to EGP.
- Credit card payments with VISA and Master Card can be made locally free of charge in the currencies Euro (EUR), US Dollar (USD) and Egyptian Pound (EGP). Please note that when paying by credit card in the local currency (EGP), the conversion from CHF to EGP is based on the CHF prices. This means that the advantages and also the disadvantages caused by currency fluctuations must be accepted.
VII. Benefits/refunds
Services:
The services that the customer may purchase from SUBEX are personal and non-transferable. Detailed information on our products can be found at www.subex.org.
The execution of all programs may be subject to the following restrictions:
- - natural limitations, such as natural disasters, sea conditions and weather conditions
- - restrictions due to official measures
- - personal limitations, e.g. health problems or abilities.
SUBEX reserves the right to change the booked program on site or to refuse.
Refund:
In principle, there is no right to a refund for services not taken.
VIII. Declaration of participation
Each guest signs the declaration of participation on site. With this he confirms physical integrity and participation at his own responsibility. In the case of minors, the declaration of participation is co-signed by their legal guardians.
IX. Cancellation and No-Show
Cancellation:
Cancellation of services booked and paid for in advance is possible. If the cancellation is made in writing at least 2 days before arrival, the booked and paid services will be refunded as follows:
Version A) Financial refund of the paid service with the deduction of a processing fee of 36 CHF/EUR per person.
Version B) Voucher, valid for 18 months from the date of issue, for the services booked and paid for in advance on the respective SUBEX basis without deduction of a processing fee.
No-Show:
Version A) If no written cancellation is made at least 2 days before arrival or the customer does not show up, 50% of the services paid for in advance will be refunded.
Version B) If a reservation is made on site and the customer does not show up, 50% of the booked services will be charged.
X. Data protection
In general:
The protection of data and privacy of our customers is very important to us. We process only those data and to the extent necessary to provide the service and to make our services safer and better.
Use of data:
All personal information collected and stored by SUBEX will be treated in absolute confidence and will not be disclosed to third parties under any circumstances.
Security:
We secure the data by technical and organizational measures against loss, destruction, access, modification or processing by unauthorized persons. Despite regular checks, complete protection against all dangers is not possible.
XI. Website
For our website the terms of use apply, which are deposited under terms of use homepage.
XII. Place of jurisdiction
The place of jurisdiction for all disputes is the location of the registered office.
XIII. Changes
SUBEX reserves the right to make changes to our website, terms and conditions, including these GTC, at any time. For this purpose, SUBEX will list the date of the last amendment in the GTC. In the case of a service which has already been paid for in advance, the GTCs which were valid at the time the service was paid for shall apply. Excepted from this are measures ordered by the authorities.
